USER(S) ELIGIBILITY

User(s) means any individual or business entity/organization that legally operates in India or in other countries, uses and has the right to use the Services provided by Drivers in india.com. The Services provided by Drivers in india.com is a service which enables the hiring of Servicemen for a home based solution of problems in categories such as appliances, electronics, wellness, etc, through the internet and / or mobile telecommunications devices. Our Services are available only to those individuals or companies who can form legally binding contracts under the applicable law. Therefore, user(s) must not be a minor as per Indian Law; i.e. user(s) must be at least 18 years of age to be eligible to use our Services.

Drivers in india.com advises its users that while accessing the web site, they must follow/abide by the related laws. Drivers in India is not responsible for the possible consequences caused by your behaviour during use of web site.

Drivers in India may, in its sole discretion, refuse the service to anyone at any time.

USER(S) AGREEMENT

This agreement applies to user(s) if user(s) are visitors, registered – free or paid user(s) who access the web site for any purpose. It also applies to any legal entity which may be represented by you under actual or apparent authority. User(s) may use this site solely for their own personal or internal purposes.

This agreement applies to all Drivers in India Services offered on the web site, collectively with any additional terms and condition that may be applicable to the specific service used/accessed by user(s). In the event of a conflict or inconsistency between any provision of the terms and conditions mentioned herein with those of the particular service, the provisions of the terms and conditions applicable to such specific Services shall prevail.

AMENDMENT TO USER(S) AGREEMENT

Drivers in India may change, modify, amend, or update this agreement from time to time without any prior notification to user(s) and the amended and restated terms and conditions of use shall be effective immediately on posting. If you do not adhere to the changes, you must stop using the service. Your continuous use of the Services will signify your acceptance of the changed terms.

All rights not otherwise claimed under this agreement or by Drivers in india.com, are hereby reserved. The information contained in this web site is intended, solely to provide general information for the personal use of the reader, who accepts full responsibility for its use. Drivers in India does not represent or endorse the accuracy or reliability of any information, or advertisements (collectively, the “content”) contained on, distributed through, or linked, downloaded or accessed from any of the Services contained on this web site, or the quality of any products, information or other materials displayed, or obtained by you as a result of an advertisement or any other information or offer in or in connection with the Service.

1. DEFINITIONS

1. Account — the account created by the Customer on the Site for availing Services offered through Drivers in India.
2. Additional Fee — any tolls, inter-state taxes or other levies payable to third parties or authorities in connection with a Booking.
3. Applicable Laws — all applicable statutes, enactments, rules, regulations, orders, notifications, and judicial decisions of India.
4. Application — the mobile application “Drivers in India”, as updated from time to time.
5. Booking — a request by the Customer for provision of a Service, facilitated through the Site or via phone.
6. Convenience & Site Fee — the fee payable by the Customer for the technology platform and related services provided by Drivers in India.
7. Cancellation Fee — the fee payable in accordance with Clause 11 for cancellation of a Booking.
8. City of Operation — a city in which Customers and Third-Party Service Providers (TPSPs) may request or render Services.
9. Customer — a person who has created an Account on the Application.
10. Customer Data — customer information as described in Clause 6.
11. Driver — a third-party service provider who has opted to enlist with Drivers in India to offer driving or related services. A Driver is not an employee of Edge On Manpower LLP.
12. Edge On Manpower LLP — a limited liability partnership incorporated under Indian law, having its registered office in Mumbai, including its successors, affiliates, and assigns.
13. E-Wallet — a pre-paid instrument used for making payments.
14. Fare — the amount payable for a Booking including base fare, night charges, Convenience Fee, etc.
15. Force Majeure Event — any event beyond reasonable control of Drivers in India.
16. Registration Data — name, email, phone number, and other registration information provided by the Customer.
17. Service(s) — facilitation of driving and allied services offered through the Site or call centre.
18. Site — the Application, Website, or any other software provided by Drivers in India.
19. Total Booking Fee — aggregate of the Fare, Additional Fees, and applicable taxes.
20. TPSP — Third-Party Service Provider, including Drivers or other operators.
21. Vehicle — the Customer’s motor cab or vehicle as defined under the Motor Vehicles Act, 1988.
22. Website — www.driversinindia.com or other URLs operated by Drivers in India.

2. ELIGIBILITY

2.1. You represent and warrant that you have legal capacity to accept these Terms.

2.2. You must not use the Offerings if you are not competent to contract under Applicable Laws.

2.3. Persons under 18 years may use the Offerings only under the supervision of parents or guardians.

3. REGISTRATION AND ACCOUNT

3.1. Registration requires submission of valid information.

3.2. You must ensure your details are accurate and current. False data may result in suspension.

3.3. You are responsible for maintaining confidentiality of your login credentials.

3.4. Promptly update any change in your information.

3.5. Download the correct Application version for your device.

3.6. Only one Account is permitted per user.

3.7. Report unauthorized access immediately to customer-care@driversinindia.com

4. PROVISION OF SERVICES

4.1. Drivers in India facilitates contact between Customers and TPSPs. TPSPs may accept or reject requests at their discretion.

4.2. Drivers in India will use reasonable efforts to connect you with an available Driver.

4.3. Access may be temporarily unavailable during maintenance or Force Majeure Events.

4.4. By using the Services, you agree to comply with all applicable laws and platform rules.

4.5. Drivers in India may suspend your account for misuse or non-compliance.

4.6. Third-party terms apply where applicable.

4.7. Illegal activities may lead to penalties, suspension, or blacklisting.

5. PROMOTIONS AND ADVERTISEMENTS

5.1. You consent to receive promotional and service-related communications from Drivers in India.

5.2. You may opt out by using the unsubscribe mechanism provided.

6. USE OF CUSTOMER DATA

6.1. You retain ownership of your data.

6.2. You grant Drivers in India a worldwide, non-exclusive, royalty-free license to use it for providing Services.

6.3. Drivers in India may process or transfer data to servers outside India to fulfil obligations.

7. CONFIRMATION OF BOOKING

7.1. Booking confirmation is subject to Driver availability.

7.2. Verify Booking details and notify any corrections immediately.

8. FEES

8.1. Fares are estimated before a trip; the actual Fare must be paid after completion.

8.2. All applicable taxes are payable by you.

8.3. Non-payment may result in account restriction or recovery actions.

9. METHOD OF PAYMENT

9.1. Payment may be made via cash or authorized digital modes.

9.2. By providing payment details, you authorize Drivers in India to process payments securely.

9.3. Wallet services may be provided under applicable RBI guidelines.

9.4. Wallet balances are non-transferable and non-refundable unless required by law.

10. REFUNDS

10.1. Fares once paid are non-refundable unless otherwise determined by Drivers in India.

10.2. Refunds, if applicable, will be processed to the original source or Wallet.

11. CANCELLATION POLICY

11.1. Cancellation is permitted under specified conditions.

11.2. INR 250/- cancellation fee is payable by the customer if the booking is cancelled 60 minutes before the commencement of the service.

12. REPRESENTATIONS AND WARRANTIES

12.1. You confirm that the information provided is accurate.

12.2. You have a valid license and own or control the vehicle.

12.3. You are responsible for your vehicle’s legal compliance and safety.

12.4. You will maintain valid insurance for your vehicle.

12.5. Drivers in India is not responsible for vehicle breakdowns, damage, or non-compliance.

12.6. You must not leave your vehicle unattended with a driver.

12.7. You authorize use of personal data for service delivery.

12.8. You will not smoke or consume alcohol during service.

Traffic Violations and Challans: Drivers in India and Edge On Manpower LLP shall not be responsible or liable for any traffic violations, e-challans, or penalties incurred during the use of the driver services. All fines and penalties arising from traffic or parking violations shall be the sole responsibility of the vehicle owner.

Accidents and Insurance Responsibility: In the event of an accident during the use of the Services, Drivers in India and Edge On Manpower LLP shall not be liable for any bodily injury, property damage, or third-party claims. The customer’s vehicle insurance policy shall apply, and any claims shall be settled directly between the customer, insurer, and the concerned parties.

13. CUSTOMER SUPPORT

13.1. For queries or complaints, contact customer-care@driversinindia.com.

13.2. Feedback must be fair and accurate.

13.3. Report issues within 24 hours of occurrence.

14. APPLICATION LICENSE

14.1. Drivers in India grants a limited, non-transferable, revocable license to use the App for personal use only.

14.2. You must not reproduce, resell, modify, or reverse engineer the Application.

15. CONTENT POSTED BY CUSTOMERS

15.1. You are solely responsible for content you post or share.

15.2. Content must not be defamatory, illegal, or infringe others’ rights.

16. INTELLECTUAL PROPERTY

16.1. All intellectual property in the Offerings belongs to Edge On Manpower LLP or its licensors.

16.2. You may not copy or distribute any material without prior written consent.

16.3. Third-party trademarks remain the property of their respective owners.

17. LINKS

17.1. You may link to the Website with permission, provided it does not misrepresent endorsement.

17.2. Do not use company trademarks or content without authorization.

18. THIRD-PARTY PRODUCTS

18.1. The Offerings may include third-party applications or tools.

18.2. Drivers in India is not liable for third-party products or content.

18.3. Open-source software is governed by its respective licenses.

19. CONFIDENTIALITY

19.1. Each party shall keep confidential all non-public information received from the other.

19.2. Disclosure is permitted only where required by law or to employees bound by confidentiality.

20. PERSONAL DATA

20.1. Drivers in India will not share your personal or payment details except as required by law or to process transactions.

20.2. Customers should not share personal details with drivers outside the platform.

20.3. Data will be handled in accordance with our Privacy Policy.

21. INDEMNIFICATION

You agree to indemnify and hold harmless Drivers in India, Edge On Manpower LLP, and their affiliates from any claims, losses, or damages arising from your misuse of the platform or breach of these Terms.

22. LIABILITY

22.1. Drivers in India acts only as a technology platform connecting customers and drivers.

22.2. You are responsible for your personal belongings during the service.

22.3. Drivers in India will assist on a best-effort basis in case of lost items.

Theft and Loss Disclaimer: Drivers in India and Edge On Manpower LLP shall not be responsible for any theft, loss, or damage to the customer’s vehicle or belongings by the driver or any third party. The customer shall report such incidents directly to the authorities. Drivers in India’s responsibility is limited to providing driver information as maintained in its records.

22.4. Drivers in India is not liable for filing FIRs or pursuing legal action against drivers or third parties.

22.5. Drivers in India is not liable for missed flights, damages, or indirect losses.

22.6. To the fullest extent permitted by law, total liability shall not exceed ₹1,000 (Rupees One Thousand Only).

22.7. Drivers in India shall not be liable for any loss or damage arising from customer-driver interactions outside the platform.

23. TERM AND TERMINATION

23.1. These Terms remain effective until terminated by either party.

23.2. Drivers in India may terminate your access for misuse or policy violation.

23.3. Provisions relating to liability, indemnity, and confidentiality survive termination.

24. DISCLAIMER

24.1. Drivers in India is an intermediary platform and does not employ or control drivers.

24.2. The Services are provided “as is” without warranties of any kind.

24.3. No representative is authorized to make warranties on behalf of Drivers in India.

25. NOTICE

25.1. Notices may be provided via email, SMS, or app notifications.

25.2. You may contact Drivers in India by email at customer-care@driversinindia.com.

26. ASSIGNMENT

You may not assign your rights under these Terms without prior written consent. Drivers in India may assign to affiliates or third parties.

27. GOVERNING LAW AND DISPUTE RESOLUTION

27.1. These Terms are governed by the laws of India.

27.2. Any disputes shall be settled amicably or through arbitration under the Arbitration and Conciliation Act, 1996.

27.3. The seat of arbitration and jurisdiction shall be Mumbai, Maharashtra.

28. MODIFICATION OF TERMS

Drivers in India may modify these Terms at any time. Updated Terms will be posted on the Website, and continued use implies acceptance.

29. FORCE MAJEURE

Drivers in India shall not be liable for failure to perform obligations due to events beyond its control, including natural disasters, strikes, or network failures.

30. SEVERABILITY

If any provision is found invalid, the remaining provisions shall continue in full force and effect.

31. CONFLICT

In case of conflict between these Terms and any other agreement with Drivers in India, these Terms shall prevail unless explicitly stated otherwise.
